Background
Kevin Nearing is a Partner in the Ottawa Office. Kevin graduated from Concordia University with a Bachelor of Arts (Honours) in Political Science. He received both a Bachelor of Laws and a Bachelor of Civil Laws from McGill University. He articled with the Ottawa predecessor to Borden Ladner Gervais (Scott & Aylen) in 1983 and was called to the Ontario bar in 1985. He has been with Scott & Aylen and then Borden Ladner Gervais since his call to the bar. Kevin is a member of the Ottawa General Litigation Professional Group and is the regional leader of the Construction, Engineering, Surety and Fidelity Group.
Areas of Practice
- Exclusively in the area of litigation with particular emphasis on construction disputes, including coverage issues, errors and omissions/professional liability litigation, procurement and tendering issues and most other aspects of construction law. He is also active in other areas of commercial and insurance litigation.
Professional Experience
- Extensive trial experience in the Ontario Court (General Division), as well as experience in the areas of alternative dispute resolution, particularly mediation.
Professional and Community Activities
- Member: Canadian Bar Association and the Law Society of Upper Canada.
- Mr. Nearing has presented papers on construction and insurance issues at the Canadian Institute and for the Canadian Construction Association.
- He is also a volunteer judge at the University of Ottawa Advocacy Course.
- Member of the Ottawa Construction Association Standards & Practices Committee.
- Presented at seminars on Canadian Construction Documents and Gold Seal programs for industry participants.
